대한민국 정부(ROK)와 미합중국 정부(U.S.) (이하 "당사국"이라 한다)는,
1953년 10월 1일자 상호방위조약에 따른 그들의 의무를 재확인하며,
전시지원을 통하여 미합중국 증원부대의 전개를 쉽게 하고, 그렇게 하여 그들의 전투력을 증진시킴으로써 위기, 적대행위 또는 전쟁시 한반도를 방어할 능력을 높이기를 바라며,
전시지원은 대한민국의 안전보장을 증진시키기 위하여 가능한 정도까지 확인되고, 시험되며, 연습될 것임을 인식하고,
그리고 양국간 상호 이익의 긴밀한 유대를 강화하기를 바라면서,
다음과 같이 합의하였다.
제 1 조
정 의
이 협정에 사용되는 용어
가. "전시지원"(WHNS)이라 함은, 위기, 적대행위 또는 전쟁시 대한민국이 미합중국 군대의 접수, 이동과 지속을 위하여 제공하는 군사 및 민간 자원과 지원을 말하며, 이들의 제공은 당사국간에 체결된 지원협정, 약정 또는 계획에 규정될 수 있다.
나. "예측하지 못한 전시지원"이라 함은, 어느 지원협정, 약정 또는 계획에도 포함되어 있지 아니한 전시지원을 말한다.
다. "기술약정"이라 함은, 특정 기능분야에서의 전시지원의 제공을 위한 세부적인 연합계획수립의 원칙과 한계를 규정하는 당사국간의 약정을 말한다.
제 2 조
일 반 책 임
가. 1953년 10월 1일자 상호방위조약에 따를 것을 조건으로, 미합중국은 대한민국의 안전보장과 영토보전을 공약한다. 대한민국내 미합중국 군사요원은 군사적 억지력으로서 역할을 하며, 대한민국의 방위에 대한 미합중국 공약의 명백한 표시이다. 뿐만 아니라, 미합중국은 위기,적대행위 또는 전쟁의 경우에 한반도에 미합중국 군대를 증원할 계획을 유지하고, 주요장비와 기타 전쟁지속자산을 동북아시아에 미리 배치한다.
나. 각 당사국의 헌법절차에 따라 그리고 유엔군사령부/연합군사령부 작전계획 5027(유엔사/연합사 작계5027)의 시행에 따라 외부 무력공격의 경우에, 미합중국은 대한민국에 증원할 부대를 제공하도록 계획한다. 이들 부대와 그들의 예상도착일은 유엔사/연합사 작계5027 시차별부대전개 목록 부록 가 별지 6에 수록된다. 시차별부대전개목록은 대한민국과 미합중국간의 협정을 통하여 매 2년마다 갱신된다. 유엔사/연합사 작계 5027은 한/미 II급 비밀로 분류되어 배포되며, 현용성과 적합성을 위하여 당사국에 의하여 주기적으로 검토된다.
다. 한반도에서 미합중국 군대의 전투 효율성을 높이기 위하여 대한민국은 이 협정에 따라 미합중국에 전시지원을 제공하도록 계획한다. 동원될 필요가 있는 민간자원은 국가동원령이
선포될 때까지 이용 가능하지 아니하다. 예측하지 못한 전시지원은 적절한 기술약정에 규정된 절차에 따라 제공된다. 예측하지 못한 전시지원은 대한민국 자산의 가용성에 따라 지원되며, 미합중국이 미합중국 군수부대의 전개를 통하여 또는 다른 수단에 의하여 그 기능을 다할 수 있을 때까지 계속된다.
라. 이 협정의 목적을 위하여 당사국은 위기, 적대행위 또는 전쟁이 발생한 시기를 공동으로
결정한다.
제 3 조
기존지원협정, 약정 및 계획
가. 이 협정은 전시지원을 제공하고 또한 이 협정의 발효일 이전에 당사국의 권한있는 기관에 의하여 승인된 기존의 협정, 약정 및 계획의 효력에 영향을 주지 아니한다. 부록 1은 전시지원을 제공하고 또한 사전에 확인된 미측 소요를 기초로 한 기존의 협정, 약정 및 계획을 수록한다.
나. 이 협정 서명후 확인된, 전시지원을 제공하는 추가적인 기존협정, 약정 및 계획은 상호 합의에 따라 부록 1에 추가된다.
다. 전시지원계획, 유엔사/연합사 작계 5027의 시차별부대 전개목록 및 한국에 배치된 미합중국 군대에 대한 검토는 미합중국의 소요를 충족시키기 위한 전시지원의 적합성을 결정하기 위하여 2년마다 실시된다.
제 4 조
추가지원협정, 약정 및 계획
당사국은 기존의 지원협정, 약정 또는 계획에 포함되지 아니하였으나 소요되는 어떠한 전시지원도 확인하기 위하여 모든 필요한 조치를 취하며 그리고 전시지원의 제공을 위하여 추가지원협정, 약정 또는 계획을 발전시키고 체결한다. 당사국은 상호 합의되고 또한 전시지원을 제공하는 어떠한 지원협정, 약정 또는 계획에도 이 협정의 조건을 적용한다.
그러한 협정,약정 또는 계획은 상호 합의된 대로 체결시 부록 1에 추가되며, 당사국의 법적 절차에 따라 발효한다.
제 5 조
기 술 약 정
당사국은 부록 2에 수록된 각 기능분야와 당사국에 의하여 합의된 기타 기능분야에 대하여 기술약정을 체결한다. 기술약정은 제6조에 의하여 설치되는 전시지원 연합운영위원회 의장의 서명에 의하여 발효한다.
각 기술약정은 그 기능분야에 관하여, 예측하지 못한 전시지원을 포함한 전시지원 제공의 절차, 기능분야에 관련된 적절한 용어의 정의, 그리고 당사국의 책임을 포함한다. 기술약정은 이 협정의 목적을 위하여 지원협정, 약정 또는 계획으로 보지 아니한다.
제 6 조
운 영 기 구
당사국은 당사국의 지정된 대표로 구성되는 전시지원연합운영위원회(WCSC)를 두며, 이는 전시지원을 조정하고, 제3조에 의하여 요구되는 검토를 시행하며, 적절할 경우 부록 1을 개정하며, 이 협정에 관한 당사국간의 차이점에 대한 해결을 강구하고, 이 협정에 대한 개정을
토의 및 권고하며, 그리고 각 당사국의 국내절차에 따라 이 협정에 의하여 체결된 기술약정을 검토하고 승인을 얻는다. 전시지원연합운영위원회는 그 임무, 구성 및 운영방법을 포함하는 그 설립강령을 기초한다. 전시지원연합운영위원회 설립강령은 각 전시지원연합운영위원회 공동의장의 서명에 따라 발효한다. 전시지원연합운영위원회의 대한민국 수석대표는 대한민국 국방부군수국장이 된다. 전시지원연합운영위원회의 미합중국 수석대표는 주한미군사령부 군수참모부장이 된다. 이들 양인은 전시지원 연합운영위원회의 공동의장이 된다.
제 7 조
전시지원 시험을 위한 절차
상호 합의되는대로 양 당사국은 시차별부대전개목록상의 부대와 전시지원을 연습에 포함하도록 모든 노력을 행한다. 전시지원연합운영위원회는 전시지원연습 및 시험을 위한 절차를 개발한다. 이러한 절차는 상호 합의되는대로 전시지원 연습 및 시험의 횟수, 범위, 비용 및 기타 측면을 기술한다.
제 8 조
비 용
이 협정은 이 협정 발효일전에 있던 어떠한 협정, 약정 또는 계획과도 관련된 비용에 대한 책임에 영향을 주지 아니한다. 양 당사국은 그들이 추가적인 또는 예측하지 못한 전시지원과 관련된 비용을 사례별로 자산의 가용성에 따라 원칙적으로 분담하여야 한다는 것에 합의한다.
비용분담 의무의 범위를 포함한 비용책임은 새로운 각 협정, 약정 또는 계획, 그리고 적절한
경우에는, 이 협정에 따라 체결되는 기술약정에서 정의된다.
제 9 조
발효, 존속 및 종료
이 협정은, 대한민국이 그 국내법에 따라 협정을 비준하고 미합중국이 그 헌법절차에 따라 협정을 승인하였음을 확인하는 각서의 교환이 완료됨으로써 발효한다. 협정은 어느 일방 당사국이 12월전에 서면으로 통보하여 종료되지 아니하는 한 당사국의 상호방위조약이 효력을 지속하는동안 유효하다. 각 당사국은 전시연합운영위원회를 통하여 이 협정의 개정을 권고할 수 있다. 부록 1에 수록된 협정, 약정 및 계획의 목록에 대한 추가 또는 삭제를 제외하고, 이 협정의 모든 개정은 당사국간의 서면 합의에 따라 이루어진다.
이상의 증거로, 하기 서명자는 그들 각자의 정부로부터 정당하게 권한을 위임받아 이 협정에 서명하였다.

전시지원 일괄협정에 대한 합의의사록
전시지원을 포함하는 협정·약정 및 계획을 효율적으로 시행하기 위하여 기술약정(부록 2에 수록된 기능분야에 대한)은 이들 문서에 포함된 비용과 책임을 이행함에 있어 각 당사국이 사용하는 절차를 서술한다. 이에 따라 대한민국과 미합중국은 오늘 서명된 대한민국 정부와
미합중국 정부간의 전시지원 일괄협정 제5조 기술약정에 관하여 아래 양해사항을 기록하고자 한다.
대한민국과 미합중국은 먼저 기존협정, 약정 또는 계획에서 그 책임을 확인하지 아니하고는 기술약정 협상시 각 당사국의 책임을 설정하지 아니한다.
만약 책임을 정의하는 그러한 기존 협정·약정 또는 계획이 없으면 당사국들은 기술약정이 체결되기 전에 그 책임을 정의하는 새로운 협정, 약정 또는 계획을 체결한다. 만약 그러한 협정· 약정 또는 계획이 있으나 기술약정에 확인된 책임을 충분히 정의하지 못하면 기존 협정·약정 또는 계획은 그 책임을 적절히 정의할 수 있도록 재협상된다.

UMBRELLA AGREEMENT BETWEEN
THE GOVERNMENT OF THE UNITED STATES OF AMERICA AND
THE GOVERNMENT OF THE REPUBLIC OF KOREA CONCERNING WARTIME HOST NATION SUPPORT
The Government of the United States of America (U.S.) and the Government of the Republic of Korea (ROK) (hereinafter referred to as "the Parties"), Reaffirming their obligations under the Mutual Defense Treaty of October 1, 1953; Desiring to enhance the capability to defend the Korean Peninsula, in times of crisis, hostilities, or war, by facilitating the deployment of U.S. reinforcing forces and thereby improving their combat power, through Wartime Host Nation Support; Realizing that Wartime Host Nation Support, to the extent possible, will be identified, tested, and exercised for the improvement of security in the Republic of Korea; and Desiring to strengthen the close bonds of mutual interest between their two countries; Have agreed as follows:
Article 1
Definitions
As used in this Agreement, the term:
a. "Wartime Host Nation Support" (WHNS) means military and civilian resources and assistance provided by the Republic of Korea for the reception, onward movement, and sustainment of U.S. Forces in times of crisis, hostilities, or war, the provision of which may be set forth in support agreements, arrangements and plans concluded between the parties;
b. "Unforeseen WHNS" means WHNS not included in any support agreement, arrangement or plan;
c. "Technical Arrangement" means an arrangement between the Parties that sets forth principles and parameters for combined detailed planning for provision of WHNS in a particular functional area.
Article 2
General Responsibilities
a. Subject to the Mutual Defense Treaty of October 1, 1953, the United States is committed to the security and territorial integrity of the Republic of Korea. U.S. military personnel in the Republic of Korea serve as a military deterrent and are a manifestation of the commitment of the United States to the defense of the Republic of Korea. In addition, the United States maintains plans to reinforce U.S. Forces on the Korean Peninsula in the event of crisis, hostilities, or war, and prepositions major items of equipment and other sustainability assets in Northeast Asia.
b. In accordance with each Party's constitutional processes, and upon execution of the Commander-in-Chief, United Nations Command/Combined Forces Command Operations Plan 5027 (CINCUNC/CFC OPLAN 5027), the United States plans to provide units to reinforce the Republic of Korea in the event of external armed attack. These units and their estimated arrival dates are listed in the Time Phased Force Deployment List (TPFDL), Appendix 6, to Annex A to CINCUNC/CFC OPLAN 5027. The TPFDL is updated biennially through U.S./ROK agreements. CINCUNC/CFC OPLAN 5027 is distributed with a SECRET-U.S./ROK classification and is reviewed periodically by the Parties for currency and adequacy.
c. In order to enhance the combat effectiveness of U.S. Forces on the Korean Peninsula, the Republic of Korea plans to provide WHNS to the United States in accordance with this Agreement. Civilian resources which need to be mobilized will not be available until national mobilization is declared. Unforeseen WHNS will be provided according to the procedures outlined in the appropriate Technical Arrangements. Unforeseen WHNS will be supported according to Republic of Korea availability of assets and will continue until such time as the United States may fulfill the function through U.S. logistics unit deployments or by other means.
d. For the purposes of this Agreement, the Parties will jointly determine when a crisis, hostilities, or war occurs.
Article 3
Existing Support Agreements, Arrangements and Plans
a. This Agreement will not affect the validity of existing agreements, arrangements and plans which provide WHNS and which were approved by authorized agents of the Parties prior to the effective date of this Agreement. Annex 1 lists existing agreements, arrangements and plans which provide WHNS and are based on previously identified U.S. requirements.
b. Additional existing agreements, arrangements and plans which provide WHNS and which are identified subsequent to the signing of this Agreement will be added to Annex 1 as mutually agreed.
c. A review of WHNS plans, the CINCUNC/CFC OPLAN 5027 TPFDL, and in place U.S. Forces in Korea will be conducted biennially to determine the adequacy of WHNS to meet U.S. requirements.
Article 4
Additional Support Agreements, Arrangements and Plans
The Parties shall take all necessary measures to identify any required WHNS not included in existing support agreements, arrangements or plans and shall develop and conclude additional support agreements, arrangements or plans for the provision of WHNS. The Parties shall apply the terms of this Agreement to any such support agreements, arrangements or plans which may be mutually agreed and which provide WHNS. Any such agreements, arrangements or plans will be added to Annex 1 when concluded, as mutually agreed and will become effective in accordance with the legal procedures of the Parties.
Article 5
Technical Arrangements
The Parties will conclude Technical Arrangements for each of the functional areas listed in Annex 2, as well as for any other functional areas agreed to by the Parties. The Technical Arrangements will become effective upon signature of the chairmen of the WHNS Combined Steering Committee established pursuant to Article 6 below. Each Technical Arrangement shall include, with respect to that functional area, the procedures for provision of WHNS, including unforeseen WHNS; definitions of appropriate terms related to the functional area; and the responsibilities of the Parties. Technical Arrangements shall not be considered support agreements, arrangements or plans for the purpose of this Agreement.
Article 6
Management Organization
The Parties hereby create a WHNS Combined Steering Committee (WCSC) composed of designated representatives of the Parties to coordinate WHNS, to conduct the review required by Article 3, to modify Annex 1 as appropriate, to seek resolutions to differences between the Parties concerning this Agreement, to discuss and recommend amendments to this Agreement, and to review and obtain approval of the Technical Arrangements concluded pursuant to this Agreement. The WCSC shall draft its charter which shall include its mission, composition and method of operation. The WCSC charter will become effective upon signature of the respective WCSC cochairmen. The chief U.S. representative to the WCSC will be the Assistant Chief of Staff, J4, U.S. Forces Korea. The chief ROK representative to the WCSC shall be the Director, Logistics Bureau, ROK Ministry of National Defense. These two individuals will be the cochairmen of the WCSC.
Article 7
Procedures for Testing WHNS
As mutually agreed, both Parties will make every effort to incorporate TPFDL forces and WHNS in exercises. The WCSC shall develope procedures for exercising and testing WHNS. These procedures will address the frequency, scope, cost and other aspects of exercising and testing WHNS as mutually agreed.
Article 8
Costs
This agreement shall not affect responsibilities for costs associated with any agreements, arrangements, or plans existing prior to the effective date of this agreement. Both parties agree that they should, in principle, share the costs associated with additional or unforeseen WHNS on a case-by-case basis and in accordance with the availability of assets. Cost responsibilities, including the extent of any cost sharing obligations, will be defined in each new agreement, arrangement, or plan and, when appropriate, Technical Arrangements concluded pursuant to this agreement.
Article 9
Entry into Force, Duration, and Termination
This Agreement will enter into force upon completion of an Exchange of Notes confirming that the ROK has ratified the Agreement in accordance with its domestic laws and that the U.S. has approved the Agreement in accordance with its constitutional processes. The Agreement shall remain in force while the Mutual Defense Treaty between the Parties remains in force, unless terminated by either Party upon twelve months' notice in writing. Either Party may recommend amendments to this Agreement through the WCSC. Except for additions to or deletions from the list of agreements, arrangements and plans contained in Annex 1, all amendments to this Agreement, will be made pursuant to written agreement between the Parties.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
DONE at Seoul, in duplicate, this twenty first day of November, 1991, in the English language and the Korean language, each text being equally authentic.
